Ally discovers that Elaine is cheating on Mark; meanwhile, Jackson and Larry face-off in court with surprising results.

As Ally and Larry walk home discussing the pros and cons of cohabitation, Ally spots Elaine smooching a man who is definitely not Mark! Larry advises her to forget whatever they just saw, but what's the fun in that? Back in the office, any relaxation gained from their trip to Los Angeles quickly vanishes as Cage and Fish get back to business. Fish immediately gets in a verbal sparring match with Nelle, calling her a "snippy ass Popsicle." Richard, meanwhile, is quick to assign new cases.

Jackson lands what seems to be a simple case of updating a client's will; however, Richard wants Jackson to convince the newly engaged client to draw up a pre-nuptial agreement. Meanwhile, Ling is representing a man whose son wants him deemed incompetent to run the family business. The man, Henry Thompson, was known for his ruthless business sense. After suffering a head injury, Henry became docile and downright happy - and the business suffered financial losses. Henry knows that a simple operation would reverse the condition, but he's rather enjoying life on the sunny side of the street, regardless of the corporate consequences.

Ally waits about a nanosecond before tracking down Elaine and confronting her about the kiss. Elaine admits she "slipped," and when Ally wants to know if she had sex with the guy, Elaine says "a little." Huh? The guy was someone Elaine met through a dating service before she started seeing Mark. Elaine convinces Ally it was no big deal and begs her not tell Mark. Ally agrees - and even covers for her when Elaine receives flowers from the mystery man. Later, when Jackson enlists Ally's help with the "simple" pre-nup, Ally recommends Larry to consult with the bride-to-be. Seems a little less conflict-of-interestish.

While Jackson is convincing the older, wealthier groom-to-be to protect his assets, Larry begins to place doubt in the bride-to-be's head. It isn't long before Jackson and Larry are playing out their competitiveness with their clients - and breaking up a marriage before it's even official! Luckily, Ally steps in to remind the clients just why they were getting married in the first place: Love. Remember that?

Ling's case takes a complicated turn when her client takes the stand. Opposing counsel points out that his "business is failing, his sons are turning against him and his wife has cancer," yet Henry is happy as a clam. When Henry's wife Edith takes the stand, however, the judge gets a differing point of view. She says that before the accident all he thought about was money and competition, now he's loving and kind - why should he want to be "cured" of that? It seems as if Henry might win over his sons, until Edith unexpectedly succumbs to her illness. Only then, faced with this tremendous loss, does Henry want to undergo the surgery, so that he can properly grieve for his beloved wife.

Back in the land of the cheaters, Ally is firmly stuck in the middle of Elaine's little affair. Mark is onto Elaine's little escapades and knows Ally has been covering for her. Ally sticks to her lie in order to help Elaine, but Elaine totally turns on her and tells Mark everything. Elaine turns to Richard (a career cheater) for advice on how to make it up to Mark. Obviously, he has no practical advice, but he does get Elaine to ask herself why she did it. She realizes that she and Mark are just biding time with each other. She breaks up with him and then decides to just avoid all happy people for as long as possible. Topping the list: Ally.
